  • Weil v. Kaplan, 168 Misc.2d 68 (1996): A First Department District Court holds that the statutory cause of action for retaliatory eviction arises only from certain specifically
    identified retaliatory behavior.It held that there is no  authority supporting a defense of retaliatory eviction based upon the landlord's commencement of a landlord & tenant action
